Grather Interviewed Regarding Highway Condemnation Case

McKirdy & Riskin’s Joe Grather was recently interviewed regarding a partial taking of property owned by our firm’s clients in Passaic County by the NJ Department of Transportation in connection with a highway improvement project along Route 46.  As indicated in the article in NorthJersey.com, the project will result in the loss of a Clifton family’s pool, rear yard and landscaping and other improvements as the widened highway will move closer to their home.  The case is now pending before the valuation panel of commissioners appointed by the court, and may ultimately end up before a Passaic County jury if the matter is not resolved before returning to the Superior Court.

On July 23, he will participate in a webinar being presented by the Counselors of Real Estate, entitled “Kelo v. New London: The Grasping Hand and Its Legacy”. McKirdy & Riskin’s Tom Olson and Richard DeAngelis will once again be presenting an annual seminar for the Morris County Bar Association entitled: “How to Successfully Handle Real Property Tax Appeals” at the Morris County Courthouse on Tuesday, March 3, 2015 from 5:30 to 7:30 pm. McKirdy & Riskin’s Jack Buonocore was recently interviewed regarding the litigation filed for a commercial property owner in Point Pleasant Beach, which challenges the authority of the NJDEP to acquire public beach easements on its property. McKirdy & Riskin’s Tony DellaPelle recently authored a legal update article in the Counselors of Real Estate’s Real Estate Issues magazine. The article, entitled “Property ‘Inspection’ or Taking?” discusses a pending case before California’s highest court, which will examine the rights of condemning agencies to enter privately-owned properties targeted for condemnations in order to perform pre-acquisition inspections. McKirdy & Riskin’s Tony DellaPelle was interviewed and quoted in this recent article in the Bergen Record, which discussed the backlog of property tax cases currently pending in New Jersey, and the possibility that such backlog may be getting smaller. More information is available here

McKirdy & Riskin’s Jack Buonocore was recently interviewed regarding the efforts of Long Beach Township to obtain access easements on private property. As mentioned, the lawsuit alleges that the township targeted the plaintiffs’ property because they refused to sign separate easement documents permitting the government to take part of their property and use it for the construction of a new sand dune.
